I think there is a way to make it so the fan never stops but having a brain fart. anyone know?

Are you suggesting stopping the CPU fan?  If so, not good.  What you could do is when the " beep" is occuring, briefly attempt to halt the fan by hand to see if this is the culprit. Inspect the fan while the unit is off, to verify the center, usually flat, where you wont harm your finger.

 When exactly did you see the CPU fan not on? Was is when the machine was running? If so, there lies the problem. As the CPU fan is required 100% of operating time, if the machine is powered on, posting, sleeping, hibernating, anything, the fan will run. At least I have not heard of any other option.

it stops when the sound occurs i never would touch it while pc is on. It only happens at startup sometimes and while pc is on screen saver

  So the fan is, or is not running , at the exact time of the noise

it stops running then the sound comes on. and it is a sound that is a warning from the mobo it was an option in the bios i changed it so sound would go away but i dont like the fan stopping the fan hasnt stopped since.

I wouldn't like it if my fan stopped either. You should get a new on fore sure!

but if it is stopping only when cold and starting after programs are opened that tells me it is a setting not the fan espcially if there is no noise from fan only mobo am i wrong?

i want to know if the beep comes from the chassis speaker or not? try to figure it out, you can detached it from the board  or hear it...

well it comes from the mobo for sure 100% there was a setting in the bios for when cpu fan fails alert and thats what it is the alert.
